Child support?

my ex is taking me to court, he says he cant pay support anymore for our 2 children because he is terminally ill. In 2003 he was ordered to apply for SSD and let the courts Know one way or the other and he never did. Isn't that contempt? Do you think the judge will rule in my favor? He has had me in vexatious litigation for years. If he doesnt pay anymore, we all will be living in the street.
